TERMS AND CONDITIONS OF SALE

Please read these terms and conditions carefully.

PARISLONDONING may update these Terms and Conditions at any time. You can consult the current version of the General Terms and Conditions of Sale at any time by visiting the "General Terms and Conditions of Sale" section of the Site.

The General Terms and Conditions of Sale in force at the time of the conclusion of the sales contract are those which are enforceable against you.

In addition, each time you purchase Products on the Site, you will be asked to confirm your acceptance of the present General Terms and Conditions of Sale in force at the time your order is placed. These terms and conditions can be viewed before and at the same time as you are asked to confirm your acceptance of them. To confirm your acceptance, you will need to tick the box "I have read and accept the General Terms and Conditions of Sale and Use, as well as the Privacy Policy of the maisontoufet.com website".

These General Terms and Conditions of Sale are those of PARISLONDONING, a simplified joint stock company, whose registered office is located at 6 IMP Franchemont 75011 Paris, registered in the Paris Trade and Companies Register under number 532 675 378.

  1. Scope and acceptance of the General Terms and Conditions of Sale

The purchase of products offered on the website www.www.maisontoufet.com (hereinafter the "Site") is subject to these terms and conditions of sale ("Terms and Conditions"). The Site allows you to order from PARISLONDONING a selection of products from the MAISON TOUFET brand (hereinafter the "Product(s)") online via the Internet.

The Products on the maisontoufet.com website are exclusively intended for sale to end consumers, whether natural persons or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the customer affirms that he/she is acting as a final consumer and that he/she has no intention of reselling PARISLONDONING Products for commercial purposes; he/she certifies that he/she has the legal capacity to enter into the commitments provided for herein.

  1. How to order

The Site allows a selection of Products to be ordered from PARISLONDONING immediately online via the Internet for collection or delivery to the territories specified in article 8.1 "Delivery zone").

The Site does not allow the placing of special orders which consist notably in the creation of a Product that does not exist or no longer exists in the PARISLONDONING collection, or in the adaptation or customization of a Product from the PARISLONDONING collections, and in the manufacturing of the latter by PARISLONDONING. The present General Terms and Conditions of Sale therefore do not apply to special orders.

  1. Product availability

Our offers of Products and prices are valid as long as they are visible on the Site, within the limit of available stocks. Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders of the same Product by several customers.

In the event that a Product is unavailable after you have placed your order, we will inform you by e-mail as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.

PARISLONDONING accepts no responsibility in the event of stock shortages or unavailability of Products for orders not yet accepted by PARISLONDONING.

PARISLONDONING reserves the right to change the Products offered on the Site at any time and without prior notice.

PARISLONDONING reserves the right to limit the quantity of Products that can be purchased by a customer, in accordance with the applicable provisions and in particular those of Article L121-11 of the French Consumer Code, in order to ensure a better quality of service and availability of our Products to all customers of the Website. In any case, orders may not include more than 6 products in total in a single purchase on the Website.

  1. Ordering procedure

5.1. Product selection

At any time, you can add Products to your selection by clicking on "Add to cart", and choose to finish shopping or continue browsing. You can consult your selection by clicking on "Basket" in the top right-hand menu, where you will see: the photo(s) of the Product(s), its color(s) and reference(s), the quantity(ies) chosen, its/their unit price(s) and the subtotal of the selection. You will also be able to choose your preferred delivery country and method, which will calculate the delivery charge and therefore the total amount you will pay.

The zone and delivery charges can be changed later if you wish, and the total amount will be updated accordingly.

5.2 Identification

After selecting the Product(s), click on "Confirm your order" to start the ordering process. A customer account is required to place an order on the Site:

- If you already have a customer account, you will need to log in at this stage by entering your password.

- If you do not yet have an account, you will be asked to create one by confirming your e-mail address and creating a password later, at the "Payment" stage.

Your identifiers and passwords are strictly personal, consequently you commit yourselves, to preserve these last ones in full safety and never to communicate them with thirds. In the event of loss, theft or any fraudulent use of your client account, you agree to inform PARISLONDONING immediately.

Creating an account allows you to :
- track your deliveries and consult your order history;
- return products;
- add or modify your delivery and billing addresses for future orders;
- manage the receipt of content from PARISLONDONING.

Unless proven otherwise by the client, the data recorded by the Site constitutes proof of the nature, content and date of all transactions between PARISLONDONING and its clients.

In the event of a dispute between PARISLONDONING and one of its clients concerning a transaction carried out on the Site, the data recorded by PARISLONDONING is considered valid proof of the content of the transaction, unless the client provides proof to the contrary. You can have your account deactivated at any time by sending an e-mail to Customer Service by clicking on the "Write to us" link.

Once your account has been deactivated, you are free to create a new account at any time.

5.3. Order validation

5.3.1 Validating the delivery method

You will need to validate your delivery method and fill in the delivery information required for your order to be dispatched: country of dispatch, title, first name, surname, telephone number and delivery address.

Once this step is complete, click on "Enter payment details".

5.3.2 Confirmation of payment and order settlement

You can use your delivery address as your billing address, or enter a different one. You will then be asked to select a payment method and enter the relevant information. At the end of the ordering process described above, and after you have accepted these Terms and Conditions and the Site's Privacy Policy in full, click on the "Order"/"Place Order" button.

The sales contract will then be definitively formed.

You must check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and design of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, notably due to the technical limitations of color rendering on your computer equipment. Consequently, PARISLONDONING cannot be held responsible for any non-substantial errors or inaccuracies in the photographs or graphic representations of the Products shown on the Site.

If you have any questions about the Products, you can of course contact our Customer Service department. For more information on payment methods (currency, accepted payment methods, etc.), please refer to the article below entitled "Payment methods".

Once completed, your order will be forwarded to PARISLONDONING for processing. PARISLONDONING reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if PARISLONDONING reasonably believes that the customer has violated these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.

5.3.3 Order confirmation

A summary of your order will then be sent to you by e-mail. The acknowledgement of receipt will show the total amount of the order, information relating to the cost and delivery time, the essential characteristics, quantity and price of the Products purchased. We advise you to keep this acknowledgement of receipt on paper or electronically.

In application of articles D. 213-1 and L. 213-1 of the French Consumer Code, when an order is for an amount equal to or greater than 120 Euros, PARISLONDONING keeps the written record of the contract concluded between PARISLONDONING and a customer by electronic means for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from the latter (in accordance with article D. 213-2 of the French Consumer Code).

You then have access to this document at any time by e-mail by clicking on the "Write to us" link; and proof of your identity.

  1. Prices - Payment methods accepted

6.1. Prices

Product prices are quoted in Euros, inclusive of all taxes. Except in the case of refunds made (i) when exercising the right of withdrawal or (ii) for lack of conformity and hidden defects.

PARISLONDONING reserves the right to modify the prices of the Products offered on the Site at any time and without prior notice. The Products are invoiced on the basis of the prices displayed on the Site at the time your order is placed, subject to availability of the Products ordered at that time. All orders are payable in Euros and must be paid immediately upon placing your order. In the event of unavailability of certain Products ordered (see article 4 "Product availability"), only the price and shipping costs relating to the Products available will be debited.

6.2. Accepted means of payment

6.2.1 Payment by credit or debit card

The following credit and debit cards are accepted: Visa®, MasterCard®, Maestro® American Express®. Credit card payments are authenticated and secured using the 3D Secure system. This system is also known as "Verified by Visa®", "MasterCard® SecureCode" or "American Express SafeKey®". During payment, the bank requests personal information from the Internet user to verify the cardholder's identity and validate the transaction. How to pay with 3D Secure on maisontoufet.com. After validating your bank details (card number, expiry date and cryptogram), a new page will appear on which you will be asked to enter the personal information requested by your bank. This information may be: - the answer to a personal question; - a password you have chosen beforehand; - a code sent by SMS, - your date of birth... Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation e-mail. Authentication is specific to each bank. If you have any questions about your 3D Secure code, please contact your bank directly.

Your order will only be dispatched once we have verified your payment method and received authorization to debit your card. Your account will be debited when your order is dispatched.

6.2.2 Payment by Paypal

We accept payment via Paypal. When you complete your order, if you choose the Paypal payment option, you will be automatically redirected to the Paypal platform. You will then need to log in to your Paypal account. If you do not have a PayPal account, you can create one at this time. After validating your order with Paypal, you will be redirected to the maisontoufet.com confirmation page. The payment of an exchange order is subject to the conditions of article 11.5 below.

  1. Reservation of Ownership

The Products ordered remain the property of PARISLONDONING until full payment has been received by PARISLONDONING. On the other hand, you assume the risks (in particular of loss, theft or deterioration) concerning the Products delivered from the moment when they are delivered to the address indicated at the time of the order.

  1. Terms of delivery

8.1. Delivery area

Products purchased on the site can only be delivered in mainland France (excluding Guadeloupe, Martinique, French Guiana, Reunion Island, Mayotte, New Caledonia, Corsica and the French Southern and Antarctic Territories) (hereinafter the "Delivery Zone").

It is not possible to place an order for any delivery address outside this Delivery Zone.

For security and other reasons, PARISLONDONING will not process any order for which a poste restante or P.O. box is provided. Products are shipped to the delivery address you provided during the order process.

8.2. Delivery charges

Shipping costs vary depending on the chosen delivery country.

Here are our delivery options : 

      Metropolitan France: MONDIAL RELAY: €5 / DELIVERY AT HOME: €7 / EXPRESS DELIVERY AT HOME: €10
Luxembourg, Belgium, Germany and the Netherlands: DELIVERY AT HOME: €10
Spain (excluding Balearic Islands), Austria, Portugal, Italy, Denmark, Hungary, Poland, Czech Republic, Slovakia and Ireland: DELIVERY AT HOME: €12
Finland, Greece and Sweden: DELIVERY AT HOME: €17

Initial shipping fees are waived for any order within Mainland France with a total (excluding shipping costs) over €200 including VAT.

The delivery time is estimated between 4 to 8 working days after your order has been confirmed.

For all requests for delivery from other countries, please contact customer service from Monday to Thursday, 10am to 12pm and 2pm to 5.30pm, by e-mail at bonjour@maisontoufet.com or by telephone on 06 62 72 13 44. We'll get back to you within 72 hours.

8.3. Delivery times

The following delivery times apply from the time your order is validated.

At the beginning of the order process, we will indicate the possible delivery times and methods for the Products purchased and the country of delivery chosen. This amount will be due by you in addition to the price of the Products purchased, except in the case of orders over 200 Euros as described in article 8.2). Please allow 4 to 8 working days after validation of your order.

PARISLONDONING reserves the right to split deliveries. Your credit or debit card will be debited in the same way to correspond to the price of the Products actually delivered. Transport costs will only be invoiced for a single shipment and in accordance with the indications appearing in your order summary.

If you have any questions, please contact our Customer Service department.

  1. Delivery problems

Any default or delay in delivery, or in making your Products available in store, which exceeds the delivery times mentioned in article 8.3 must be reported to our Customer Service Department as soon as possible.

Any claim made more than fourteen (14) calendar days after the date of validation of your order cannot be taken into account.

If the delivery time is not respected, you can cancel the order, simply by e-mail or registered letter to the following address: PARISLONDONING / maisontoufet.com 6 IMP Franchemont 75011 Paris.

PARISLONDONING will then be obliged to reimburse all sums paid, at the latest within fourteen (14) days following the date of cancellation of the sales contract.

If you nevertheless receive the Product after having exercised this option, you must return it in accordance with the return procedure set out in article 11 below.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged product, etc.). You must then contact Customer Services by e-mail, by clicking on the " Write to us " link.

In the event of non-conformity of the Products purchased or if you are not satisfied with them, you may return them or be reimbursed under the conditions set out in article 11 below.

  1. Right of withdrawal

10.1. Right and period of withdrawal

You have a legal right of withdrawal that you can exercise under the conditions set out in Article L. 221-18 of the French Consumer Code, if you meet the conditions set out in these provisions, without having to justify your decision and without having to pay any penalties.

PARISLONDONING's general return policy (for refund) allows you to cancel your order within fourteen (14) days from the date of delivery of the Products, without having to justify your reasons and without having to pay any penalty. After this period, you will no longer be able to exercise your right of withdrawal.

We do not make standard exchanges on our website www.maisontoufet.com. For a new size, another model or another color, simply reorder on
our e-shop.

10.2. How to exercise the right of withdrawal

We offer you the possibility of completing and sending your declaration of withdrawal online by logging into your customer account. You will then receive immediate confirmation of your withdrawal by e-mail. You may also, before the expiry of the 30-day withdrawal period mentioned above, send any other unambiguous statement expressing your wish to withdraw to the following address: PARISLONDONING / maisontoufet.com 6 IMP Franchemont 75011 Paris.

If the customer so wishes, he may use the model retraction form available in the appendix to these General Terms and Conditions of Sale.

10.3 Consequences of the right of withdrawal

When exercising your right of withdrawal or in the event of non-conformity of the Product, you may return the Product(s) purchased and request a refund under the conditions described in article 11 below.

    11.1 Free return procedure to maisontoufet.com
    When exercising the right of withdrawal, Products must be returned in their original condition and packaging (including the box and shipping carton), accompanied by their purchase invoice or a copy in the case of a partial return.

The return of a Product, in the event of a refund request, is free of charge only in metropolitan France (excluding Corsica).
To do this, you must return the Products to us via our carrier, within a maximum period of 14 days from your declaration of withdrawal,

  • Prepare the product intact in its packaging (original box, pouch, etc.).
  • Print the return form and stick it on your parcel
  • Contact DHL customer service on 0825 10 00 80
  • A driver will collect the parcel from the address of your choice.

From abroad and Corsica, returns are at your expense and must be made within 14 days. You can contact customer service from Tuesday to Friday from 10am to 12pm and from 2pm to 5:30pm by email at bonjour@maisontoufet.com or by telephone on 06 62 72 13 44.

11.2 Refunds from maisontoufet.com

In the event of a refund request, the refund will be made within seventy-two (72) working hours of receipt of the product(s). A confirmation e-mail will be sent to you. The refund, including delivery costs for the original order, will be made using the same method of payment used for the order, and in the same currency as that used by the customer to pay for the order.

Please note that your bank may take up to ten (10) business days to credit the refund back to your card, depending on processing times. This varies between card issuers, and unfortunately, we cannot expedite this process as it is beyond our control.

11.4 Return and refund conditions for orders paid with PayPal at maisontoufet.com

In the event of a request to exchange an order paid for with PayPal, your bank or credit card details will be required if the amount of the new order is greater than the amount of the original order. Any amount over and above the amount of the original order can only be paid by credit or debit card. We are unable to accept payment by PayPal for the additional amount due for an exchange order. If the amount of the new order is equal to the amount of the original order, you will not need to provide your credit or debit card information and no new payment will be required. If you request a refund for an order paid by Paypal, your PayPal account will be credited with the amount of the original order.

  1. Legal warranties

The Products sold by PARISLONDONING are subject to the legal warranties stipulated in the articles of Section 2 of Chapter VII of Title I of Book II of the French Consumer Code as well as articles 1641 to 1648 of the French Civil Code, to the exclusion of all other warranties:

- Legal warranty of conformity :

PARISLONDONING will deliver to you a Product that conforms to the contract and is free from defects of conformity at the time of delivery of said Product, in the sense that the Product will be fit for the use usually expected of a similar good and that it will present the characteristics presented at the time of sale.

PARISLONDONING is also responsible for any lack of conformity resulting from the packaging when this has been made its responsibility by the contract or has been carried out under its responsibility. This warranty will only apply if you request it within two years of delivery of the goods.

Defects of conformity that appear within six (6) months (legally extended to twenty-four (24) months as of March 18, 2016) of delivery are presumed to exist at the time of delivery, unless proven otherwise. You may choose between repairing or replacing the Product, unless one of these choices would result in a manifestly disproportionate cost for PARISLONDONING. If repair or replacement of the Product is not possible, you may obtain a refund of the price paid and return the Product or keep the Product and obtain a refund of part of the price, unless the lack of conformity is minor.

The return, replacement or refund of the Product will be at no cost to you and does not preclude the possible award of damages should you be entitled thereto. The legal warranty of conformity applies independently of the commercial warranty indicated below.

- Legal warranty against hidden defects :

PARISLONDONING will deliver to you a Product free from latent defects which render it unfit for its intended use, or which diminish this use to such an extent that you would not have purchased it, or would only have paid a lower price for it, had you been aware of them. This warranty will only apply if you make a claim within two (2) years of the discovery of the defect.

In the event of a latent defect, you will have the choice of returning the Product and having the price and costs of the sale refunded to you, or keeping the Product and having part of the price refunded to you. In all cases, it is up to you to prove that you meet the warranty conditions.

  1. After-sales service

All technically repairable products are covered by an after-sales service. For any repair, please contact our Customer Service. In accordance with article L 111-3 al 1 of the French Consumer Code, PARISLONDONING confirms that no period of availability of spare parts essential to the use of the Products is guaranteed. PARISLONDONING will nevertheless make its best efforts to satisfy its Clients in the event of a request for one or more spare parts.

  1. Limitation of liability

Under no circumstances will PARISLONDONING be held responsible for any damage that does not result from a breach by PARISLONDONING of one of its obligations.

  1. Applicable law - Disputes

These General Terms and Conditions of Sale shall be governed by and construed in accordance with French law.

However, in application of EC Regulation 593/2008 of June 17, 2008, these general terms and conditions of sale do not preclude the application of a provision more favorable to the customer, which cannot be derogated from by agreement, under the law of the country where the customer has his habitual residence.

In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, the customer has the option of resorting to a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with order no. 2015-1033 of August 20, 2015 and implementing decree no. 2015-1382 of October 30, 2015, any so-called consumer dispute or litigation, subject to article L612-2 of the French Consumer Code, may be settled amicably by mediation with the CMAP - Centre de Médiation et d'Arbitrage de Paris.

To submit a dispute to the mediator, the customer may (i) fill in the form on the CMAP website: www.cmap.fr under the "You are: a consumer" tab (ii) send the request by ordinary or registered post to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an e-mail to consommation@cmap.fr.

Regardless of the means used to refer the matter to the CMAP, the client's request must contain the following elements in order to be processed rapidly: postal, email and telephone contact details as well as the full name and address of PARISLONDONING, a brief statement of the facts, and proof of prior contact with PARISLONDONING.

Notwithstanding the foregoing, in the event of a dispute, and in accordance with Regulation No. 1215/2012 of December 12, 2012:
- the customer may refer the matter either to the court of his domicile, or to the French courts,
- PARISLONDONING may bring the matter before the court of the customer's place of residence.

In the event of a dispute relating to the execution of an order, if you are an individual end consumer, you have the possibility of resorting free of charge to a conventional mediation procedure or any other alternative dispute resolution procedure. If you wish, you can use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No. 524/2013. This platform can be accessed at the following address: https://webgate.ec.europa.eu/odr/. Recourse to mediation is an alternative mechanism that is not a prerequisite for legal action.
